As Vesna Giyim Sanayi ve Ticaret Limited Şirketi (“VESNA” or “Company”), this Commercial Electronic Message Information Text has been prepared to inform you about the processing, storage, and transfer of your personal data within the scope of sending commercial electronic messages to you, under Law No. 6563 on the Regulation of Electronic Commerce (“ETK”), Law No. 6698 on the Protection of Personal Data (“KVKK”), the Regulation on Commercial Communication and Commercial Electronic Messages, and other relevant legislation.

Your identity information (name, surname), contact information (phone number and e-mail address), customer transaction information (shopping, order, campaign, discount, coupon, and similar transaction information), and marketing information (commercial electronic message preferences, campaign participation information, information regarding customer preferences and tendencies) that you have shared with VESNA through the website, campaign and discount wheel, membership, shopping, store, customer services, and other communication channels, may be processed for the purposes stated below, provided that you give your consent for commercial electronic messages and, where explicitly required, your explicit consent for personal data processing activities.

In this context, your personal data may be used for the following purposes: sending commercial electronic messages through communication channels you have approved, including SMS, e-mail, and WhatsApp, promoting and marketing VESNA products and services, announcing new products and collections, informing you about campaigns, discounts, opportunities, advantages, promotions, gifts, coupons, and similar benefits, planning and executing sales and marketing activities, carrying out customer satisfaction efforts, planning and executing customer relationship management processes, analyzing customer preferences and habits, determining target audiences, performing customer segmentation, creating personalized campaigns and offers, customizing and recommending products and services to you based on your interests, preferences, shopping history, and usage habits, conducting direct marketing and remarketing activities, measuring advertising and campaign performance, performing marketing analyses and market research, improving customer experience, and conducting internal reporting and analysis activities.

Activities related to sending commercial electronic messages will be carried out based on your commercial electronic message consent obtained under Article 6 of Law No. 6563 on the Regulation of Electronic Commerce and the Regulation on Commercial Communication and Commercial Electronic Messages. Regarding personal data processing activities carried out within the scope of commercial electronic message activities, appropriate processing conditions stipulated in the KVKK will be taken as a basis; for marketing, profiling, segmentation, or personalization activities requiring explicit consent, your explicit consent under Article 5, paragraph one of the KVKK will be relied upon.

Within the scope of your commercial electronic message consent, VESNA may send you marketing content such as campaigns, discounts, opportunities, new products, new collections, advertisements, promotions, advantages, and similar. Messages may be sent via SMS, e-mail, and/or WhatsApp channels, depending on the scope of your consent.

Your personal data may be processed directly by VESNA or through electronic message, SMS, information technology, software, hosting, customer relationship management, marketing, and technological infrastructure service providers from whom VESNA receives services, for the purpose of sending commercial electronic messages, managing consent and refusal preferences, and conducting campaign and customer communication processes.

Your personal data may be transferred to electronic message and SMS service providers, information and technological infrastructure providers, e-commerce and customer relationship management service providers, marketing and analysis service providers, and legally authorized public institutions and organizations, in a limited, related, and proportionate manner for the purposes explained above, in accordance with the personal data transfer conditions specified in Article 8 of the KVKK.

In cases where personal data is transferred abroad within the scope of using internationally linked services and technologies such as WhatsApp/Meta and Google, such transfer will be carried out in accordance with the conditions and appropriate transfer mechanisms stipulated in Article 9 of the KVKK and the Regulation on the Procedures and Principles for the Transfer of Personal Data Abroad.

Your commercial electronic message consent is independent of your membership, order, delivery, invoicing, return, exchange, or other contractual relations with VESNA. Operational notifications necessary for the execution of the service, such as order taking, preparation, shipping, delivery, payment and invoicing processes, or the fulfillment of your customer request, may be evaluated separately from commercial electronic message consent depending on their nature and relevant legislation.

You can withdraw your consent for sending electronic commercial messages at any time without stating any reason. You can change your commercial electronic message preferences or refuse to receive messages by using the Message Management System (“İYS”) or by using the refusal/unsubscribe methods specified in commercial electronic messages sent by VESNA (refusal codes for SMS, unsubscribe links for e-mails, or WhatsApp redirections). Following the receipt of your refusal notification by VESNA, the sending of commercial electronic messages will be stopped within three business days.

The withdrawal of commercial electronic message consent does not affect the legality of operations carried out lawfully before the withdrawal. Furthermore, the withdrawal of commercial electronic message consent does not automatically terminate personal data processing activities carried out by VESNA to fulfill its legal obligations, ensure the performance of the contract, or rely on another legal reason stipulated in the KVKK.

You can submit your requests regarding your rights under Article 11 of the KVKK to VESNA in accordance with the application procedures and methods stipulated in the relevant legislation.
